This Agreement describes the terms and conditions governing and applicable to your use of the USIMMIGRATIONFORMS.COM’s internet portal and online services provided to you on this website, which includes, but not limited to content, updates and new releases and online software and tools (collectively, the “Services”). It also includes Privacy Statement provided to you in the Services available on USIMMIGRATIONFORMS.COM’s website or provided to you separately the Services, including product or program terms, technical support, ordering, activation, payment terms or otherwise. We reserve the right to amend or modify this Agreement at any time, and the modifications will be effective when posted our website or when we notify you by other means, whichever is earlier. The Services are protected by copyright, trademark, trade secret, patent and/or other intellectual property laws. You are only permitted to use the Services for the purposes described by USIMMIGRATIONFORMS.COM. Until termination or cancellation of this Agreement and as long as you comply with any applicable payment obligations and this Agreement, USIMMIGRATIONFORMS.COM grants to you a personal, nonexclusive, nontransferable, not assignable and limited right and license to use the Services. You explicitly agree not to use, nor permit any third party’s use, the Services or content in a manner that violates any provisions of this Agreement or your local jurisdiction and any other applicable laws. In particular, you (1) agree not to provide access to or give any part of the Services to any third party; (2) copy, reproduce, revise sell, advertise or trade the Services; (3) share the Services or make them available on any file-sharing or application hosting service.
All payments will be billed to you in U.S. dollars, and your account will be debited when you subscribe to the Services and provide your payment information unless agreed otherwise in writing between you and USIMMIGRATIONFORMS.COM. You agree to pay with a valid credit or debit card acceptable by USIMMIGRATIONFORMS.COM or by another acceptable payment option USIMMIGRATIONFORMS.COM provides to you in writing or through a 3rd party affiliate or software program. If, for any reason, your payment and registration information is not accurate, updated and complete and you do not notify us promptly when the information changes, USIMMIGRATIONFORMS.COM reserves the right to suspend the Services or terminate your account and refuse its future Services to you. If your payment information changes (e.g. new debit card number or expiration date) to avoid interruption of the Services we may participate in programs supported by your credit or debit card provider to attempt to update your payment information and you authorize USIMMIGRATIONFORMS.COM to continue billing your account with the updated information that we obtain.
You may use our online services free of charge until you are satisfied with our product or decide to download or print your completed immigration forms. Downloading or printing the forms indicates that you are satisfied with the product and agreed to pay a non-refundable fee.
USIMMIGRATIONFORMS.COM can be used through a compatible mobile device. You agree that you are solely responsible for these requirements including any applicable updates and/or changes and fees as well as the terms of your agreement with your mobile devise or telecommunication provider: (1) USIMMIGRATIONFORMS.COM makes no warranties of any kind as to the availability of telecommunication services from your mobile provider and access of the Services from any location at any time; (2) USIMMIGRATIONFORMS.COM is not responsible for any loss, damages or other security intrusion of the telecommunication services; and (3) any disclosure of information to third parties.
You are responsible for all information and documents or materials (“Content”) uploaded, typed, posted, stored, printed or filed through your use of USIMMIGRATIONFORMS.COM. Intuit is not responsible for the Content or data you submit to USCIS or any other U.S. government instrumentality though the Services.
You agree not to use the Services, nor permit anyone to use the Services, to engage in, post, type, reproduce or transmit illegal, fraudulent, obscene, hateful, harassing or other inappropriate or objectionable information of any kind or otherwise to cause damages to anyone. You also agree that you would not use information of any third party without obtaining prior consent or to falsely represent your identity or qualifications.
USIMMIGRATIONFORMS.COM reserves the right to monitor content of the Services and disclose any information necessary to satisfy its legal obligations, protect its rights or rights of its customers and to protect its business. USIMMIGRATIONFORMS.COM may refuse to post, remove or refuse to remove any information or content in its sole discretion.
USIMMIGRATIONFORMS.COM is not in the business of providing legal, financial, accounting or other professional services or advise. USIMMIGRATIONFORMS.COM does not provide legal advise, opinion or recommendations about your particular case or situation. We are not a law firm and, therefore, may not perform services usually performed by a licensed attorney in your jurisdiction. You agree that you will not use or claim to use the Services to substitute an advise of an attorney.
USIMMIGRATIONFORMS.COM may offer or advertise services, including professional, products or promotions by USIMMIGRATIONFORMS.COM or third parties (“Third Party Providers”). If you choose services of the Third Party Providers you agree to indemnify and hold harmless USIMMIGRATIONFORMS.COM from any dispute, disagreement or any issues resulted from your use, communication or relationship with the Third Party Providers.
You are responsible for securely managing your personal information and password for the Services and to immediately contact USIMMIGRATIONFORMS.COM if you become aware of any unauthorized access to your account. The Services may be updated with tools necessary to store your information securely. You agree to receive and comply with these updates.
YOUR USE OF THE SERVICES, SOFTWARE, AND CONTENT IS ENTIRELY AT YOUR OWN RISK. EXCEPT AS DESCRIBED IN THIS AGREEMENT, THE SERVICES ARE PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, USIMMIGRATIONFORMS.COM, ITS AFFILIATES, AND ITS THIRD PARTY PROVIDERS, LICENSORS, DISTRIBUTORS OR SUPPLIERS (COLLECTIVELY,”SUPPLIERS”) DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY THAT THE SERVICES ARE FIT FOR A PARTICULAR PURPOSE, TITLE, MERCHANTABILITY, DATA LOSS, NON-INTERFERENCE WITH OR NON-INFRINGEMENT OF ANY INTELLECTUAL PROPERTY RIGHTS, OR THE ACCURACY, RELIABILITY, QUALITY OR CONTENT IN OR LINKED TO THE SERVICES. USIMMIGRATIONFORMS.COM AND ITS AFFILIATES AND SUPPLIERS DO NOT WARRANT THAT THE SERVICES ARE SECURE, FREE FROM BUGS, VIRUSES, INTERRUPTION, ERRORS, THEFT OR DESTRUCTION. USIMMIGRATIONFORMS.COM, ITS AFFILIATES AND SUPPLIERS DISCLAIM ANY REPRESENTATIONS OR WARRANTIES THAT YOUR USE OF THE SERVICES WILL SATISFY OR ENSURE COMPLIANCE WITH ANY LEGAL OBLIGATIONS OR LAWS OR REGULATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE ENTIRE LIABILITY OF USIMMIGRATIONFORMS.COM, ITS AFFILIATES AND SUPPLIERS FOR ALL CLAIMS RELATING TO THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO SUCH CLAIM. SUBJECT TO APPLICABLE LAW. USIMMIGRATIONFORMS.COM, ITS AFFILIATES AND SUPPLIERS ARE NOT LIABLE FOR ANY OF THE FOLLOWING: (A) INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES; (B) DAMAGES RELATING TO FAILURES OF TELECOMMUNICATIONS, THE INTERNET, ELECTRONIC COMMUNICATIONS, CORRUPTION, SECURITY, LOSS OR THEFT OF DATA, VIRUSES, SPYWARE, LOSS OF BUSINESS, REVENUE, PROFITS OR INVESTMENT, OR USE OF SOFTWARE OR HARDWARE THAT DOES NOT MEET USIMMIGRATIONFORMS.COM SYSTEMS REQUIREMENTS. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS USIMMIGRATIONFORMS.COM AND ITS AFFILIATES AND SUPPLIERS HARMLESS FORM ANY CLAIMS, LIABILITY AND EXPENSES, INCLUDING REASONABLE ATTORNEYS’ FEES AND COSTS, ARISING OUT OF YOUR USE OF THE SERVICES OR BREACH OF THIS AGREEMENT.
New York state law governs this Agreement without regard to its conflicts of laws provisions.
Any and all dispute(s) or claim(s) relating in any way to the Services or provisions of this Agreement shall be settled by mediation under the Construction Industry Mediation Procedures of the American Arbitration Association. If within 30 days after service of a written demand for mediation, the mediation does not result in settlement of the dispute, then any unresolved controversy or claim arising from or relating to this contract or breach thereof shall be settled by arbitration administered by the American Arbitration Association in accordance with its Construction Industry Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. WE EACH AGREE THAT ANY AND ALL DISPUTES MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. BY ENTERING INTO THIS AGREEMENT AND AGREEING TO ARBITRATION, YOU AGREE THAT YOU AND USIMMIGRATIONFORMS.COM ARE EACH WAIVING THE RIGHT TO FILE A LAWSUIT AND THE RIGHT TO A TRIAL BY JURY. IN ADDITION, YOU AGREE TO WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR LITIGATE ON A CLASS-WIDE BASIS. YOU AGREE THAT YOU HAVE EXPRESSLY AND KNOWINGLY WAIVED THESE RIGHTS. .
You agree to use the Services solely to prepare valid U.S. immigration forms for which you have paid applicable fee(s) unless USIMMIGRATIONFORMS.COM agreed in writing to provide you with the Services free of charge. You agree that you will not use the Services for any commercial purpose of any kind and will reimburse USIMMIGRATIONFORMS.COM with any fees or payments collected by using the Services. USIMMIGRATIONFORMS.COM reserves the right to limit the number of same immigration forms.
The Services may include an advertisement or a feature that connects you to immigration attorneys or law firms (“Attorney”) to request a review of your account or information, a legal consultation or transfer of services to an attorney. Whether you choose to use it or not, you understand and agree that USIMMIGRATIONFORMS.COM will not sign your immigration form as the preparer. If you choose to use services of the Attorney advertised on USIMMIGRATIONFORMS.COM you agree to be bound by the Attorney’s website’s terms and conditions and any retainer that you will sign with the Attorney and not be entitled to claim a credit for the services performed by USIMMIGRATIONFORMS.COM. You further agree to indemnify and hold harmless USIMMIGRATIONFORMS.COM from any dispute, claim or disagreement you might have with the Attorney.
USIMMIGRATIONFORMS.COM may use a various means including, but not limited to, phone, fax, e-mail, chat, or video to provide technical support and customer service in connection with the Services. The support representative of USIMMIGRATIONFORMS.COM cannot render a legal advice and answer any questions that may require or constitute a legal advise.
USIMMIGRATIONFORMS.COM strives to ensure the accuracy of its content and information and immigration quiz results but does not guarantee that they are always 100% due a particular nature situation. If your immigration application was denied as the result of your failure to enter all required information accurately or follow our instructions we will not be responsible your damages. If you believe your mistake was caused by us you must notify USIMMIGRATIONFORMS.COM as soon as you learn of the mistake by email or mail.
You can transfer your data and information, including your daft or completed immigration forms, from USIMMIGRATIONFORMS.COM to 3rd party, including an attorney, (“transferee”) after completing an authorization form provided to you upon request. Once the transfer is complete you agree to indemnify and hold USIMMIGRATIONFORMS.COM harmless from any dispute, claim or disagreement you might have with the transferee.
